Refunds or credits may be issued at the sole discretion of East Coast Wings in cases where an order is incorrect, incomplete, or fails to meet reasonable quality standards. 7. Limitation of Liability

7.1 Aggregate Liability Cap

To the maximum extent permitted by applicable law, the total aggregate liability of East Coast Wings, its officers, directors, employees, agents, licensors, and service providers, to you for any and all claims arising out of or relating to these Terms or your use of the Website or services, shall not exceed the greater of: (a) the total amount paid by you to East Coast Wings in the twelve (12) months immediately preceding the event giving rise to the claim; or (b) One Hundred United States Dollars ($100.00).

In no event shall East Coast Wings, its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, service interruption, computer damage or system failure, or the cost of substitute goods or services, arising out of or in connection with these Terms or your use of the Website or services, even if East Coast Wings has been advised of the possibility of such damages.

7.3 Third-Party Services

The Federal Trade Commission Act (15 U.S.C. § 41 et seq.) and applicable FTC regulations regarding unfair or deceptive trade practices are acknowledged and respected by East Coast Wings in the conduct of its business operations.

11. Dispute Resolution

11.1 Informal Resolution

You and East Coast Wings agree to negotiate in good faith to resolve any such dispute within thirty (30) days of the submission of a written notice describing the nature and basis of the dispute and the relief requested.

If the parties are unable to resolve a dispute through informal negotiation within the thirty (30) day period described above, either party may elect to have the dispute finally and exclusively resolved by binding arbitration. The arbitration shall be conducted under the Commercial Arbitration Rules of the American Arbitration Association (AAA) in effect at the time the dispute is submitted, as modified by these Terms. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding upon both parties. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

11.3 Class Action Waiver

YOU AND EAST COAST WINGS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

11.4 Exceptions to Arbitration

Notwithstanding the above, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or confidential information.

11.5 Small Claims Court

Either party may bring an individual action in small claims court, provided the matter remains in such court and proceeds only on an individual (non-class, non-representative) basis, consistent with applicable small claims court rules and jurisdictional limits.
